Rental, Indemnity and Warranties
This is a contract for the rental of the vehicle. We may repossess the vehicle at your expense without notice if it is abandoned or used in violation of this agreement or the law. You agree to indemnify and hold us harmless from any claims, liability, costs, or attorney fees arising from your use of the vehicle. We make no warranties, express or implied, regarding the vehicle’s merchantability or fitness for a specific purpose.
Condition and Return of Vehicle
You must return the Vehicle to our rental office on the date and time specified in this Agreement, and in the same condition that you received it, except for ordinary wear. If the Vehicle is returned after closing hours, you remain responsible for the safety of, and any damage to, or loss of, the Vehicle until we inspect it upon our next opening for business. Service to the Vehicle or replacement of parts or accessories during the rental must have our prior approval. You must check and maintain all fluid levels.
Responsibility for Damage or Loss
You are responsible for all damage to, or loss of, the vehicle—including repair costs, loss of use, diminished value, and any related administrative expenses. If the vehicle is deemed irreparable, you are liable for its fair market value. All accidents, thefts, or acts of vandalism must be reported promptly to both us and the police.
Breach of Agreement
Prohibited uses include, but are not limited to:
Operation by unauthorized drivers or those without valid licenses
Use under the influence of alcohol or drugs
Use in illegal activities or off-road driving
Overloading, racing, towing, or carrying unrestrained passengers or cargo
Use beyond specified geographic limits
Transporting animals or hazardous materials
Tampering with odometer or neglecting vehicle maintenance
Violation of any of these terms will result in a breach of contract. You waive all claims against us related to law enforcement actions taken due to such violations.
Insurance
You are responsible for any damage or injury caused to others while using the rental vehicle. You must carry valid auto liability, collision, and comprehensive insurance. If you do not have applicable coverage, and where required by law, we may provide secondary liability coverage up to the minimum limits required by state law. Optional coverage can be declined or accepted at the time of rental.
Charges
You agree to pay all charges related to the rental, including but not limited to:
Rental time and mileage
Fees for additional drivers, optional products, or services
Fuel costs if returned with less fuel than received
Applicable taxes and fees
Fines, penalties, tolls, and violations
Costs associated with vehicle recovery or late return
Cleaning fees (if vehicle is returned excessively dirty)
Collection and attorney fees for unpaid charges
Deposit
We may apply your security deposit toward any unpaid charges incurred under this agreement.
Your Property
We are not responsible for the loss or damage of personal property left in the vehicle or at our facility, regardless of cause.
Modifications
No part of this agreement may be modified or waived unless in writing and signed by an authorized representative of our company. Extensions must be arranged in person with vehicle inspection and written approval.
Miscellaneous
Waiver of any term does not constitute waiver of future terms. Acceptance of payment does not limit our rights under this agreement. If any part of this agreement is found to be unenforceable, the remaining terms shall remain valid. We are not liable for special, consequential, or punitive damages resulting from this rental.
